The paper aims to investigate whether (and how) the economy produces constitutional rules, and whether (and how) the economic science can (or should) be used by the theory of law in the interpretation process, in particular constitutional interpretation. The development of the arguments is based on the theory of economic constitution, and responds positively to both questions. The essay concludes with an analysis of a case concerning the choice of electoral system in the light of the fiscal constitution.
