The article analyzes a recent reference for a preliminary ruling made by the Italian Constitutional Court to the Court of Justice in the context of the complex dialogue between these two Courts. It further highlights some still critical aspects of the new order of referrals proposed by the Consulta in situations of so-called “dual preliminarity” (to the Constitutional Court and to the Court of Justice), in a case concerning the relationship between the right to silence (enshrined at the same time in the Italian Constitution, in the Charter of Fundamental Rights of the EU and in the ECHR) and “punitive” sanctions.
