A theme that arises in the reflections presented in this short paper is the penitentiary legal system and the social justice system; the paper attempts to give answers to related issues through restorative justice. Certainly, one of the brightest authors in contributing to this reflection on modern law in the early twentieth century is Max Weber. Even if his remarks are sometimes fragmentary, Weberian thought still manages to produce a representation of the logical and methodological categories of the legal system. Further contributions, certainly more incisive in our current judicial and prison system, are attributable to the so-called legal and social prophets: Cesare Beccaria, Foucault, Bentham, etc.
